This Website and directly associated marketing channels including telephone, email and interpersonal contacts (collectively referred to as "Website") are operated by Your Personal AED Expert, LLC D.B.A. Good To Be Alive ("Company"), which is a South Carolina limited liability company with its office located at 23-B Shelter Cove Lane, 100-A, Hilton Head Island, South Carolina 29928.

These are the terms and conditions for use of this Website between you ("Customer") and Company. Company reserves the right to modify these terms and conditions without prior notice. These terms and conditions must be reviewed and agreed to contemporaneously with every use of this Website.

Customer use of this Website and/or purchase of merchandise constitutes agreement to the following terms and conditions and all applicable laws, as governed by the laws of the state of South Carolina. If Customer does not agree to any of these terms and conditions, Customer shall not use this Website or otherwise communicate with or purchase merchandise from Company.

Shipping: Company anticipates purchases will result in successful shipment to Customer within 4 to 14 business days. Company does not guarantee shipment within 4 to 14 business days. Circumstances may exist that require more time for delivery of merchandise. Customer acknowledges that timely shipping is not guaranteed. Expedited shipping is available, but is not guaranteed.

Customer acknowledges there may be certain orders that Company is unable to accept and must cancel. Company reserves the right, at its sole discretion, to decline or cancel any order for any reason including but not limited to limitations on quantities available for purchase, inaccuracies or errors in merchandise or pricing information, or problems identified by government authorities or manufacturers. Company may require additional verifications or information before accepting any order. If order is canceled after Customer has been charged, Company will refund Customer in the amount of the charge without payment of interest.

Return policy: Company accepts returns for reasonable objections within 30 days of purchase subject to condition of merchandise. A return authorization must be acquired from Company prior to returning merchandise by calling 888-696-1233 and requesting a return authorization; specific logistical instructions will be provided by a Company representative. All items are subject to a 15% restocking fee. Disposable items with "broken seals" (opened packaging) such as pads or batteries cannot be returned. Shipping of goods intended for return is the responsibility of the Customer including any associated shipping and/or insurance fees.

Privacy: Company does not utilize, sell, or share any personal information of Customer for any purpose other than fulfillment of Customer order and directly associated Courtesy Services including but not limited to communications regarding maintenance of merchandise ("Courtesy Services").

Company operates this Website on an 'as is,' 'as available' basis, without representations or warranties of any kind. To the full extent permitted by law, Company disclaims any and all representations and warranties with respect to this Website's content and merchandise offered or purchased, whether express, implied, or statutory, including, but not limited to, warranties of title, merchantability and fitness for a particular purpose or use. This disclaimer does not apply to any product warranty offered and maintained by merchandise manufacturers.

Company is a retail seller of automated external defibrillators and related accessories and consumables (collectively "AEDs" or "AED"). Company does not assume any responsibility or liability associated with ownership, operation or utilization of AEDs.

Company may provide Courtesy Services. Courtesy Services are not to be relied upon. Courtesy Services notwithstanding, the owner of each AED is responsible for its maintenance and readiness. Company does not warrant or guarantee Courtesy Services.

Customer hereby acknowledges and understands that AED utilization does not always result in a positive outcome. The resuscitation of a person who has experienced sudden cardiac arrest is dependant on a number of factors and can never be guaranteed. It is unreasonable to rely on or expect a positive outcome when utilizing an AED. Company assumes no risk or responsibility for Customer use of any of the merchandise sold by Company.

Without limiting the foregoing, the Company does not represent or warrant that the information on this Website is accurate, complete or current or that this Website will operate without interruption or error.

Without limiting the foregoing, Company disclaims any liability as to the accuracy or completeness of each item description. All merchandise descriptions originate from the manufacturer. Any supplemental merchandise descriptions provided by Company are for marketing purposes only and do not represent any medical, legal or other professional advice. Company makes no representations or warranties of any sort related to merchandise descriptions.

The information contained on the Company Website has been devised without reference to societal, prescribing, dispensing conditions or laws, other than those of the United States. Company does not sell merchandise outside of the United States, Customer shall not attempt to purchase for shipping or use outside of the United States.

The responsibility of AED ownership and maintenance is the Customer's responsibility including but not limited to acquisition, purchasing, maintenance, manufacturer updates and any other activities associated with ensuring readiness of AEDs. This is a comprehensive limitation of liability that applies to all losses and damages of any kind (whether general, special, consequential, incidental, exemplary or otherwise, including, without limitation, personal injury, loss of life, loss of data, income or profits), whether in contract, negligence or other tortious action, even if an authorized representative of Company has been advised of or should have known of the possibility of such damages. If any part of this limitation on liability is found to be invalid or unenforceable for any reason, then the aggregate liability of Company under such circumstances for liabilities that otherwise would have been limited shall not exceed two hundred dollars ($200).

Company reserves the right to limit order quantities in its sole discretion. Company gift cards are deemed purchased in and issued from the state of South Carolina.

Any interactive portions of Company Website through which Customer submits content are provided with the understanding that any such submissions constitute Customer transfer of all rights to Company regarding said content. Customer hereby grants to Company irrevocable, royalty free, non-exclusive, and transferable license to use, reproduce, prepare derivative works of, distribute, publicly display, transmit and publish content provided by Customer.

Further, any material downloaded or otherwise obtained through the use of Company Website is done at Customer's own risk. Customer will be solely responsible for any damage to any computer system or loss of data that results from the download of any such material.

Regarding third party content/software, Company is not responsible for the content from any third party that may be connected or "linked via hyperlink" to Company Website. Any connection or link to any third party content is not an endorsement of same and no judgment or warranty is made with respect to the accuracy, timeliness, or suitability of the content.

Any software, videos or other formatted information made available for downloading from or through this Website is licensed subject to the terms of any applicable license agreement.
